Legal Consultant – MIDAS Legal Assessment

About the role

The International Organization for Migration (IOM) seeks a qualified legal expert to conduct a comprehensive legal assessment for the MIDAS Border Management Information System deployment in Lesotho. The consultancy will evaluate existing legislation, regulatory frameworks, and policy instruments to ensure compliance with national data protection, immigration, and human rights standards.

Key responsibilities

• Review constitutional, legislative, regulatory and policy instruments governing border management, migration, identity management, data protection, privacy, information management and cybersecurity.
• Assess the legal basis for collection, processing, storage, retention, transmission, sharing and protection of personal and biometric data within MIDAS.
• Evaluate alignment with constitutional protections, international human rights obligations, regional commitments and recognized data protection principles.
• Identify gaps in legal, regulatory, policy and institutional arrangements affecting border management data governance and MIDAS sustainability.
• Develop practical recommendations and a roadmap to strengthen the legal and institutional framework for border management data.

Required profile

• Qualified legal professional with expertise in data protection, privacy law, and border/migration legislation.
• Demonstrated experience conducting legal assessments for government or international projects, preferably in the African context.
• Strong knowledge of Lesotho’s Data Protection Act, immigration and border management laws, and relevant international standards.
• Ability to produce clear, actionable recommendations and implementation roadmaps.
